Warsaw (Puls Biznesu) – The authorities controlling public tenders may ask the court to cancel the contract for BSE tests. Poland may lose millions of euros again.

UZP, the Polish Public Procurement Office, issued an opinion stating that the fund responsible for Phare contracts (FW) signed the agreement with Roche Diagnostics  Polska to deliver BSE tests illegally. UZP considers applying at a court to cancel the agreement. A similar case is already going on as a small company CHS Computers which lost the tender filed the same suit. Poland may lose PLN 11m (EUR 2.8m).

“It must be a mistake. We signed the agrement with UZP approval. We have an opinion. I see no problem”, Mateusz Kujawa, FW CEO said.

The problem is that UZP agreed for the transaction when FW chose the offer of CHS. The Publish Procurement Office said that the fund should have asked for a new approval prior to signing the agreement with Roche. There are many controversies over this tender. Similar tenders conducted at the end of the year 2004 and in the beginning of the year 2005 were cancelled twice and Poland lost its chance for EUR 12m of EU funds. In fall 2005, a tender was announced again with PLN 30 in the budget. Only two offers were submitted by CHS (PLN 25m) and Roche (PLN 11m). Roche’s offer was initially rejected due to formal mistakes and the company appealed. When Roche took part in the tender for the second time, and won, CHS protested and stressed that low price may mean low quality of the deliveries. Early this year it turned out that laboratories have problems with the tests, including low output. The case is being investigated.
