Although TP telecom had asked Prime Minister Jaroslaw Kaczynski for help, it is included on the list of ‘golden share’ companies, i.e. those, where the state may object to shareholders’ decisions. Now, the Confederation of Private Employers Lewiatan, is suing the decision to the Constitutional Tribunal.
A telecommunication company may be included on the
list of strategic companies if it owns infrastructure enabling to broadcast
radio and TV signal on 70 percent of the country. The infrastructure TP is using
belongs to its subsidiary TP Emitel which is already on the list of strategic
companies. The Ministry of the Treasure has 3.96 percent stake of TP telecom.
France Telecom is the majority shareholder.
