Warsaw (Puls Biznesu) – The approval may be issued within 2-3 weeks.
Chances are big that the Competition and Consumer Protection Office (UOKiK) will approve of the acquisition of nitrogen plants Kedzierzyn and Tarnow by German Petro Carbo Chem (PCC). The investigation is still going on however the positive decision may be issued within 2-3 weeks.
“The proceeding is going on and the results are confidential. The investigation is about to end but we still receive data which can influence the decision”, UOKiK press officer said.
On April 20, two MPs sent a statement to the PM, the Minister of Economy and the Minister of the Treasure informing that PCC is connected with Tarnow and Kedzierzyn rivals, including German RAG, the owner of Degussa, as well as Kloecker company. This issue is also being investigated by UOKiK.
“There are no connections between RAG and PCC. Juergen Stadelhofer, the CEO of RAG Coal, is the member of PCC supervisory board as a private person with huge experience and knowledge”, Marzena Ambroziak, PCC advisor to Poland said.
UOKiK’s decision would be vital for PCC in the acquisition of Poland’s biggest nitrogen producers. However, the investor will have to wait for the decision of the government and the Ministry of the Treasure who are the GSM of Nafta Polska, the owner of both companies. PCC signed the privatization agreement with Nafta Polska in March. PCC pledged to invest PLN 498m in Tarnow.
