| W nawiązaniu do raportu bieżącego nr 74/2020 z 30 października 2020 r. Zarząd Energa SA („Spółka”) informuje, że Spółka otrzymała postanowienie Komisji Nadzoru Finansowego („KNF”) z dnia 15 stycznia br. o zawieszeniu postępowania administracyjnego w sprawie udzielenia zezwolenia na wycofanie 269 139 114 akcji Spółki z obrotu na rynku regulowanym. Podstawą ww. zawieszenia są pozwy, o których Spółka informowała w raportach bieżących nr 80/2020 z 9 grudnia 2020 r. oraz 82/2020 z 16 grudnia 2020 r. W uzasadnieniu postanowienia KNF podała art. 97 § 1 pkt 4 k.p.a. jako podstawę prawną zawieszenia postępowania oraz wskazała, że rozpatrzenie sprawy i wydanie decyzji zależy od wcześniejszego rozstrzygnięcia zagadnienia wstępnego przez sąd. |

| Current Report No. 2/2021 Date: 20 January 2021 Subject: Suspension by the Polish Financial Supervision Authority of the administrative procedure on the authorization to withdraw Energa SA shares from trading on the regulated market Legal basis: Article 17 (1) of MAR – inside information With reference to the current report No. 74/2020 of 30 October 2020 the Management Board of Energa SA ("Company") informs, that it received the decision of the Polish Financial Supervision Authority (“KNF”) of 15 January 2021 on the suspension of the administrative proceedings on the authorization to withdraw 269 139 114 shares of the Company from trading on the regulated market. The grounds of the above-mentioned suspension are lawsuits about which the Company informed in current reports No. 80/2020 of 9 December 2020 and 82/2020 of 16 December 2020. In the justification of the decision, the KNF provided Art. 97 § 1 point 4 of the Code of Civil Procedure as the legal basis for the suspension of the proceedings, and indicated that the consideration of the case and the issuing of a decision depends on the prior decision of a preliminary issue by the court. |
