| W nawiązaniu do raportu bieżącego nr 25/2021 z 25 czerwca 2021 roku Zarząd Energa SA („Emitent”) informuje, że powziął informację o podpisaniu w dniu 3 października br. pomiędzy spółką CCGT Ostrołęka Sp. z o.o. a GE Power Sp. z o.o. z siedzibą Warszawie i General Electric Global Services GmbH, z siedzibą w Baden, Szwajcaria (łącznie „Generalny Wykonawca”) aneksu („Aneks”) do umowy z dnia 25 czerwca 2021 roku dotyczącej projektu budowy elektrowni gazowo-parowej (CCGT) o mocy 745 MWe netto w Ostrołęce („Projekt”). Zgodnie z zapisami Aneksu szacunkowe wynagrodzenie Generalnego Wykonawcy z tytułu realizacji Projektu wzrośnie z ok. 2,5 mld zł netto do ok. 2,85 mld zł netto. Termin podpisania Świadectwa Obioru Warunkowego elektrowni CCGT w Ostrołęce został ustalony na 31 grudnia 2025 roku. Zawarcie Aneksu wynika z konieczności dostosowania umowy z Generalnym Wykonawcą do uwarunkowań, które zaistniały od momentu zawarcia tej umowy, w tym w szczególności do wybuchu wojny w Ukrainie i jej wpływu na rynek surowców, energii i budowlany. |

| Current report No. 26/2023 Date: 3 October 2023 Subject: Changes regarding the implementation of construction project of CCGT power plant in Ostrołęka Legal basis: Article 17 (1) of MAR - inside information With reference to the current report No. 25/2021 of 25 June 2021, the Management Board of Energa SA ("Issuer") informs that it has become aware of the signing on 3 October 2023 between CCGT Ostrołęka Sp. z o. o., on the one side, and GE Power Sp. z o. o. with its registered office in Warsaw and General Electric Global Services GmbH, based in Baden, Switzerland (collectively the "General Contractor") on the other side of the annex ("Annex") to the agreement of 25 June 2021 regarding the project of the construction of a 745 MWe net gas-fired combined cycle gas turbine (CCGT) power plant in Ostrołęka ("Project"). In accordance with the provisions of the Annex, the estimated remuneration of the General Contractor for the implementation of the Project will increase from approximately PLN 2.5 billion net to approximately PLN 2.85 billion net. The deadline for signing of the Conditional Acceptance Certificate for the CCGT power plant in Ostrołęka was set for 31 December 2025. The conclusion of the Annex results from the need to adapt the contract with the General Contractor to the conditions that have arisen since the conclusion of this contract, in particular the outbreak of the war in Ukraine and its impact on the raw materials, energy and construction markets. |
