| W nawiązaniu do raportu bieżącego nr 25/2021 z dnia 25 czerwca 2021 roku, Zarząd Energa SA („Emitent”) informuje, że powziął informację o podpisaniu w dniu 22 grudnia 2021 roku między spółką Elektrownia Ostrołęka sp. z o.o. („EO”) a Generalnym Wykonawcą – GE Power sp. z o.o. z siedzibą w Warszawie i GE Steam Power Systems S.A.S. (poprzednia nazwa: ALSTOM Power Systems) z siedzibą w Boulogne-Billancourt Francja (lider konsorcjum – GE Power sp. z o.o.) – aneksu do porozumienia dotyczącego rozliczenia Projektu Węglowego w ramach kontraktu dotyczącego budowy Elektrowni Ostrołęka „C” z dnia 25 czerwca 2021 roku („Aneks”). Aneks przedłuża termin rozliczenia do dnia 25 marca 2022 roku i wynika ze zweryfikowanego mechanizmu rozliczania Projektu Węglowego. Całkowita kwota, o której Emitent informował w raporcie bieżącym nr 25/2021 z dnia 25 czerwca 2021 roku, jaką EO będzie zobowiązana zapłacić na rzecz Generalnego Wykonawcy nie uległa zmianie i nie przekroczy 1,35 mld zł (netto). |

| Current Report No. 41/2021 Date: 22 December 2021 Subject: Signing the annex to agreement regarding the settlement of the Coal Project under the contract for the construction of the Ostrołęka "C" Power Plant Legal basis: Article 17(1) MAR - inside information. With reference to the current report No. 25/2021 of 25 June 2021, the Management Board of Energa SA (“Issuer”) informs that it has become aware of the signing on 22 December 2021 between Elektrownia Ostrołęka Sp. z o.o. (“EO”) and the General Contractor – GE Power sp. z o.o. with its registered office in Warsaw and GE Steam Power Systems S.A.S. (former business name: ALSTOM Power Systems S.A.S.) with its registered office in Boulogne-Billancourt, France (leader of the consortium – GE Power sp. z o.o.) – the annex to the agreement regarding the settlement of the Coal Project under the contract for the construction of the Ostrołęka "C" Power Plant of 25 June 2021 (“Annex”). The Annex extends the settlement period until 25 March 2022 and results from the verified settlement mechanism of the Coal Project. The total amount reported by the Issuer in the current report No. 25/2021 of 25 June 2021 that EO will be required to pay to the General Contractor has not changed and will not exceed PLN 1.35 billion (net). |
