Strabag unhappy with tender

The German Strabag has complained about the way in which a contract was awarded for the extension of Warsaw’s Okecie airport. Several days ago a consortium of the Spanish Ferrovial, Polish quoted Budimex and Estudio Lamela won.

Strabag claims that the tender was unfair as it treated parties differently, unclear and that its own rules were broken.

Waldemar Mierzwa, press spokesperson for Budimex, has declined to comment.

Strabag is dissatisfied at the way the contract was won. It says that in the opinion of the main airport specialist engineer, Ryszard Jędruch, the proposal of the consortium based around Ferrovial did not fullfil the requirements of the tender and therefore could not be considered. Strabag also claims that the winners” offer did not fullfil the requirements of a lighting system which could threaten security at the airport and that the solution proposed is older than that currently in service. The winner’s proposed a price of USD206m whilst Hochtief suggested USD274.6m and Strabag USD279m.

Strabag says that apart from the cost, the proposal of Ferrovial-Budimex-Studio Lamela was considered to be weak with costs under estimated.

The Germans also have procedural complaints. One of these is that the deadline to get bids in was extended. Strabag suggests that this may have been to give Ferrovial more time to prepare documentation. The make up of the tender commission was changed in March and Strabag suggested that this has a corrupting influence.
